Footer isn't a sectioning root:

http://www.whatwg.org/specs/web-apps/current-work/multipage/sections.html#sectioning-root

You might have been thinking of sectioning content, but the only elements that are sectioning content are section, aside, nav and article:

http://www.whatwg.org/specs/web-apps/current-work/multipage/content-models.html#sectioning-content-0

Footer is flow content:

http://www.whatwg.org/specs/web-apps/current-work/multipage/content-models.html#flow-content-0

The footer question is an interesting one, and I'm assuming it's related to the footer of a website rather than an article say. With the days of huge footers upon is, I can easily see why people might want to have separate sections and the like within a footer element.
